To prevent the introduction of the death penalty for homosexuality in Uganda.
On September 25th 2009 a Ugandan Bill was published and presented to the Ugandan government. The Bill has become known as the “Anti-Gay” Bill, and it is a direct breach of human rights within the country and worldwide. The Bill outlines that Ugandan people who are lesbian, gay, bi-sexual or transgender can and will be forcefully detained, and charged with the “Offence of homosexuality”. Many Ugandan LGBT people who have been affected by this bill are now forced to live in fear, or flee their native land to seek asylum elsewhere. This Bill violates many human rights, in contravention of international treaties, such as the UN Declaration of Human Rights:
- The Right to be Free from Discrimination
Under the new bill LGBT people in Uganda will be forced to endure legal discrimination and persecution from members of the public, officers of the law and the authorities.
- The Right to Privacy
The Anti-Homosexuality bill will see LGBT people’s lives invaded as they are subject to arrest, questioning and imprisonment on the basis of their private lives.
- The Right to Liberty and Security
The Bill is further used as a basis for arbitrary arrests and detention of a person solely on the basis of their sexual orientation (actual or assumed) or gender identity.
- The Right to Health
The re-criminalization of homosexuality and “aiding and abetting homosexuality” would negatively impact on the availability, accessibility, acceptability and quality of health services for lesbian, gay, bisexual or transgender people.
- The Right to Life
The introduction of this Bill will also see the reinstatement of the Death Penalty for “Aggravated Homosexuality”. A person may be sentenced to death if found to be a ‘repeat offender’ and any sexual interaction with a member of the same sex. People living with HIV can also be sentenced to death or life imprisonment, as can the same-sex consentual partner of a person with a disability.
